How to handle a neighbour dispute professionally

Neighbour disputes can be stressful, but putting your complaint in writing is an important first step β€” it creates a record and often resolves the issue without further escalation.

🏘 Escalation options if the letter doesn't work

  • Environmental health: Report persistent noise or other statutory nuisances to your local council. They can serve a noise abatement notice
  • Community mediation: Many councils offer free mediation services β€” a neutral third party helps both sides reach agreement
  • The landlord: If your neighbour is renting, their landlord has a responsibility for their tenants' behaviour and can be written to as well
  • Solicitor's letter: For serious boundary or property damage disputes, a solicitor's letter often resolves things quickly
What counts as a statutory noise nuisance? β–Ύ
Under the Environmental Protection Act 1990, noise that unreasonably interferes with the use and enjoyment of your home can be a statutory nuisance. The council's environmental health team can investigate and issue a noise abatement notice. Persistent breach of a noise abatement notice is a criminal offence.
Who owns a boundary fence or wall? β–Ύ
Boundary ownership is usually indicated in your title deeds or Land Registry documents. If unclear, a solicitor can advise. The Party Wall Act 1996 sets out rules for building work near or on a shared boundary.
My neighbour's tree is damaging my property β€” what can I do? β–Ύ
You have the right to cut back branches and roots that overhang your boundary, but must offer the cuttings back to your neighbour (as they remain their property). If the tree has caused damage, you may have a civil claim against your neighbour for negligence or nuisance.
